Family claims wrongful death in long beach police shooting of mentally disabled man
LONG BEACH, calif. (KABC) -- mharloun saycon was shot and killed by long beach police last year after allegedly waving a knife inside a popular arcade.
His grieving family says saycon was diagnosed bipolar-schizophrenic and was not a threat to the public at the time of his death. They're seeking $20 million in a wrongful death claim filed against the city thursday.
"mharloun was a good person. He was my son. He didn't deserve this. [he had] a mental disability. He should not have been killed for that," saycon's mom, anna luz saycon, said during a press conference.
Authorities were dispatched to looff's lite-A-line casino game of skill in the 2500 block of N. Long beach boulevard at 10:08 p.M. On dec. 14 in response to a report of an armed man inside the business.
The suspect was allegedly waving his knife, prompting customers to flee the arcade in fear, long beach police sgt. Brad johnson said.
Saycon refused to follow police officers' orders to drop his knife, police said. Long beach police officers tried to subdue him with a taser and a baton, but it was ineffective and an officer-involved shooting occurred.
Saycon was pronounced dead at the scene. No officers or customers were injured, and a knife was recovered at the scene.
Joe sayas, an attorney representing the saycon family, says saycon "was not exhibiting any violent or aggressive action and neither was he a threat to anyone at that scene."
The saycon family plans to file a lawsuit. They want major changes to use-of-force procedures and the officers involved in saycon's death to be prosecuted by the los angeles county district attorney's office.
"we need to acknowledge that mentally disabled people are human beings as well. So does law enforcement, so does anybody," a member of the saycon family said.
Eyewitness news spoke with two people who witnessed the shooting at the popular arcade. They did not want to appear on camera, but one of the two witnesses said saycon was not a threat and that police did not have the right to shoot him. The other witness chose not to comment.
Surveillance footage of the incident was provided to law enforcement, but police did not answer eyewitness news' questions due to pending litigation. The city attorney's office said it has not seen the claim.

Long beach police shot and killed a knife-wielding man at an arcade after trying less-lethal options, authorities said tuesday.
Officers went to looff’s lite-A-line casino game of skill, 2500 long beach blvd., at 10:08 p.M. Monday in response to a report of a man inside the business with a knife, said long beach police sgt. Brad johnson.
A subsequent report received before officers arrived indicated the man was waving the knife and some customers had left in fear of their lives, johnson said. Another report indicated the man had been thrown out of the business once before for being disruptive.
Once officers were on the scene, the man disregarded their verbal commands to drop the knife, the sergeant said.
“officers tried a less-lethal electronic control device and baton and neither less-lethal force was effective,” he said. “an officer-involved shooting occurred.”
Officers started life-saving measures and arriving long beach firefighters continued the effort until pronouncing the man dead at the scene, johnson said.
His name was withheld pending notification of his family.
“no officers or citizens were injured and a knife was recovered at the scene,” he said.
“limited portions of the incident were captured on video, which will be reviewed by homicide detectives, in addition to the L.A. County district attorney’s office,” according to a police statement.
Northbound long beach boulevard was closed from burnett to willow streets while an investigation was underway.

City of long beach settles lawsuit filed by family of man fatally shot by police

A $2 million settlement has been reached in the 2015 fatal police shooting of a california man whose family said was mentally disabled and alleged in a lawsuit that one of the officers fired his gun eight times though he and his partner were not in danger.
Attorneys for the family of mharloun saycon announced the agreement on wednesday, saying in a news release that the long beach city council approved the $2 million payment during a closed session meeting on dec. 5.
“hopefully the settlement is something that sends a message that it is going to cost the city money to have lawless police officers on the streets,” saycon family attorney dan stormer said in a phone interview.
Howard russell, deputy city attorney for the long beach city attorney's office, said they believe the officers acted reasonably and lawfully.
“whenever anyone chooses to settle, it’s because there is a chance of a greater financial liability if there's an adverse verdict," he said.
Russell said both officers are still with the long beach police department.
The city did not admit liability or wrongdoing in the settlement, according to a copy provided by stormer.
Police shot and killed saycon, an immigrant from the philippines, on dec. 14, 2015, after responding to a 911 call of a man with a knife inside a casino arcade.

Saycon, 39, had been in the looff's lite-A-line casino game of skill for around four and a half hours when a manager saw him scratching the surface of a game table with a pocket knife, the lawsuit alleged.
The manager asked saycon to put away the knife, which he did, but later saycon walked over to a patron he knew, began chatting, and showed off the knife to him, according to the suit. Saycon, who the lawsuit asserted was diagnosed with paranoid schizophrenia in his early 20s, did not point the pocket knife at the customer, nor did the customer feel threatened, the court filing alleged.
Several other patrons noticed the knife and alerted a manager, one of whom tried escorting saycon from the arcade, the lawsuit said. But saycon stopped at the exit, prompting another manager to phone the police, according to the court filing.
A news release from saycon family attorneys said that staff made it clear in the 911 call that saycon wasn’t threatening anyone and that they only needed help leading him off the premises. The lawsuit maintained that the responding officers were also made aware of saycon’s mental disability.
The night of the shooting, the officers arrived as saycon sat in a chair with a closed pocket knife in his lap and watched television, the lawsuit asserted.
They shouted at saycon to drop the knife, the lawsuit alleged.
“when mharloun did not immediately respond, the officers tased him, and then one of the officers lunged at mharloun and beat him in the head with a baton,” the suit asserted.
Seconds later, one of the officers fired eight times from nearly 15 feet away, hitting saycon in the chest, arm and abdomen, according to the lawsuit and news release. He died at the scene.
In a statement released a day after the shooting, the long beach police department said the responding officers received an update while en route that saycon was in fact waving a knife inside the arcade and that some customers had left because they feared for their safety.
When officers arrived, they came upon saycon who was sitting and still armed, police said. Saycon, according to the police statement, did not drop the knife when ordered to do so. Officers subsequently used an "electronic control device" and a baton on saycon, which police said were both ineffective.
Following the shooting, officers immediately began life-saving measures on saycon, police said.
Court papers responding to the saycon family’s lawsuit against the city of long beach and the two officers argued that reasonable force was used and that the officers’ actions were lawful and justified.
“mharloun saycon was shot in the immediate defense of life following his refusal to submit to several lesser uses of force,” reads a 2017 court filing from the long beach city attorney and lawyers representing the officer who fired the shots. “there is no relevant evidence regarding mharloun saycon's mental health, as there is no competent evidence that this was ever known to the defendant officers.”
Khanly saycon, mharloun saycon’s father, said in a statement that all they want is their son, who he said deserved to live.
“while nothing can bring him back to us, if this case saves even just one life by holding the police more accountable for how they treat people with mental illness, that’s the most I can hope for,” khanly saycon said.

Long beach police shoot, kill man who was seated at arcade with knife

Police shot a man threatening patrons of a historic long beach gaming venue with a knife monday night — while he was sitting.
The man who was shot, identified by the los angeles county coroner’s office only as a 39-year-old carson resident, was waving the knife at looff’s lite-A-line casino game of skill at 2500 long beach blvd. Near the wrigley neighborhood shortly after 10 p.M.
“we can confirm that he was in a seated position at the time of the shooting,” said cmdr. Robert luman, who heads the long beach police department’s gang and violent crimes division. “we’re investigating the posture and the perceived threat of him being in possession of a knife.”
The man’s seated position does not mean he wasn’t a threat, luman said.
Officers gave the man verbal commands to drop the knife, but he did not comply, according to information provided by the department. Police then used less-lethal weapons, including a baton and taser before firing shots.
Authorities are investigating why the less-lethal means failed to subdue the man, and a clearer picture should emerge once the coroner’s office conducts the autopsy and completes its full report, luman said.
The knife was recovered at the scene.

Officers fatally shot a man allegedly wielding a knife and threatening customers at a family-owned gaming hall in long beach monday night, police said.
Police received a call around 10:08 p.M. About a man armed with a knife at looff's casino game of skill in the 2500 block of long beach boulevard, according to the long beach police department.
Patrons at the gaming hall said they felt threatened and ran out of the building, said lt. Brad johnson of the long beach police department.

Police said the officers' attempts were ineffective as the man continued waving the knife and an officer-involved shooting occurred, johnson said.

No other injuries were reported.
The officer-involved shooting was under investigation.
The suspect's identity was not released, but police said he was a 39-year-old carson resident.
