Weitergehend sagt das BSG, dass viele der ausgaben auch nur zur privaten freude und nicht etwa konkret und gezielt zur gewinnerzielung getätigt wurden.

Damit hätte krause von seinem gewinn, sofern er den hartz-4-lebensstandard beibehalten hat, noch 4.500 euro von seinem 9.999,70 euro gewinn übrig behalten.

Aktueller ist die situation von rené aus berlin-karow – ebenfalls ein hartz-4-empfänger. Sein gewinn viel bescheidener aus. Es waren „nur“ 210 euro, die ihm sein lottoschein einbrachten. Erlaubter zuverdienst: hartz-4-empfänger haben kaum möglichkeiten geld dazuzuverdienen. Mit 1-euro-jobs ist es möglich bis zu 100 euro zu verdienen, die nicht angerechnet werden.

Ab wann lohnt sich ein lottogewinn für hartz-4-empfänger?

Freilich lässt sich auf diese frage keine pauschale antwort finden. Zunächst einmal wird das kapital der leistungsempfänger angerechnet. Wer keine hilfsbedürftigkeit mehr vorweisen kann, der muss wohnung und lebensunterhalt auch alleine stemmen. Demzufolge sind gewinne, die nicht über den herkömmlichen leistungsbezug über den entsprechenden zeitraum hinausgehen, gewissermaßen nur ein vorschuss. Wer beispielsweise drei millionen euro abräumt, der braucht sich natürlich nicht davor zu fürchten, keine sozialleistungen mehr zu beziehen.

Wenn gewinne, zumindest zum teil, für eigene zwecke verwendet werden können, wären auch fortbildungsmaßnahmen zu erwägen, die nicht vom amt gezahlt werden. In diesem sinne könnte sich der lottogewinn als ausfahrt aus hartz 4 entpuppen. Wenn im anschluss die chancen steigen, wieder auf dem arbeitsmarkt fuß zu fassen, lohnt sich eine investition. Und anschließend, wenn der leistungsbezug ausgesetzt ist, können gewinne aus glücksspielen vollständig behalten werden.

Lotto als ausweg aus hartz 4? Diese ansicht birgt ein risiko. Immerhin sollen arbeitslose nicht zum spielen ermutigt werden.
